민간임대주택에서 이른바‘매매예약금’을 둘러싼 피해 우려가 커지면서 금융당국이 소비자 주의를 당부했다.전세보증금과 유사하게 인식되지만 법적 보호를 받지 못하는 구조라는 점에서 각별한 주의가 필요하다는 지적이다.
금융감독원은 13일 일부 민간임대주택 사업장에서 임대차 계약과 함께 분양전환을 조건으로‘매매예약금’납입을 유도하는 사례가 발생하고 있다며 소비자경보를 발령했다.해당 금액은 임대보증금이 아닌 별도의 사적 계약에 해당해 법적 보호 대상이 아니라는 설명이다. 
문제는 임대사업자가 파산하는 등 사고가 발생할 경우다.매매예약금은 임대차보호법상 우선변제권이 인정되지 않고,주택도시보증공사(HUG)의 전세보증금 반환보증 대상에도 포함되지 않아 사실상 회수가 어려울 수 있다.
이 같은 구조는 제도 취지와도 맞지 않는다는 지적이다.국토교통부도 지난 2023년 각 지자체에 공문을 보내 매매예약 사례가 발생하지 않도록 지도했다.
